What is Needed From You
Here are some things that we require from you in order to keep the flight safe and legal. We have made it easy and also segment sections for A breach in any of the below may result in the immediate termination of the service without refund! Cal Drone LTD and Pilots are not held liable if you or the entity breach any of the following.
General Requirements
While it isn’t required by law to get written permission to fly over someone’s property, we however do require a signature in writing for permission to launch drones from private property that is also dated and lists the address or address(s). The signature has to be from the property owner or an authorized staff member/manager if it’s from a business/entity. The dates required for flying shall be listed in the document with a start and end time in the local time zone. Falsifying property ownership signatures is illegal and will result in immediate termination of services with no refund.
Everyone on the property must be notified for the possibility of the drone flight(s) and to stay out of the drone launch site and be made aware of the possible hazards. Please contact us for the possible hazards.
Kindly inform neighbors in the surrounding area within reason, that a drone flights are taking place within the area. If it’s for a pet search just let people know this could happen any day and at any hour. As mentioned earlier no permission to fly over property by law is required, however this will help reduce any conflicts. Cal Drone LTD will ask for a forum to be signed and completed once this has been completed!!!
Privacy is very important at Cal Drone! We shall not be used to conduct espionage of any form, voyeurism, nuisance, harassment, or defacing anyone or other entity. This means under many circumstances no flying at window level height,(with some exceptions for real estate projects) tracking of people unless in the case of saving a life or with their permission, and imaging areas where privacy is to be expected such as areas with privacy fencing within reason.(not always possible to avoid this but must be mitigated within reason) Exception being at the request from a government agency or in the case of saving a life or saving property. Cal Drone LTD shall not attempt to violate any of the above under any circumstances. However you must understand that area’s may be viewed unintentionally given the nature of drone flying. In the event of a complaint or incident we may retain video for documentation purposes for court or training. If any video ends up in your hands or within a entity that contains video violating any of the above, you must delete or cut out segments containing any breaching contents mentioned above and or retain information in regards to Canadian Privacy Laws or Provincial Privacy Laws in regards to where the drone flights took place.
You must understand that the weather is variable and forecasts aren’t always accurate. Cal Drone LTD and pilots may postpone the flight at the pilots and Cal Drone LTD discretion if deemed unsafe/illegal for flight. Flight safety and legality is a must, Transport Canada AIM’s is a good resource to read in regards to weather legality and safety if you have time to read.(fear not we have read this for you) We are more than happy to reschedule if needed. If within reason the pilots may issue a refund upon request. if a refund isn’t issued, then payment shall be credited in full to the rescheduled flight. Airspace dependent, we may require 7 days or more notice before the drone flights. Though a plenty of areas in Canada are instant approval. Cal Drone LTD cannot control this.
You and anyone else or entity involved in the flights/operations must obey the pilot in command instructions at all times. Failure to comply may result in termination of services and include Transport Canada fines.
For safety, all non essential for flight people/entities (except pilots and trained visual observers) must remain clear of the designated drone launch site marked by either pylons, tape, landing pad, area on diagram, or vocally designated area while drone(s) are powered on or at discretion of pilot in command.
Any shooting at drones flying or grounded and crew will result in termination of services and will result in prosecution to the fullest extent under Canadian Law and Transport Canada Laws. Shooting at a drone in Canada is considered the same as shooting at a manned aircraft. You do not have legal permission to shoot at drones even if it’s over yours or any entities property!!! Any photo’s, videos, and audio capturing occurrence will be retained and used in court. LOCAL POLICE OR RCMP WILL BE CONTACTED!!!
